ORDER : The Court Made the following order :- The petitioners, who were arrested on 25.07.2017 for the offence punishable under Sections 294(b), 506(i), 420 IPC and Section 5 r/w 7(3) of Lottery Regulation Act in Crime No.523 of 2017 on the file of the respondent Police, seeks bail. 2.The case of the prosecution is that the first petitioner has borrowed a sum of Rs.10,000/- from the de facto complainant. On 25.07.2017 when the de facto complainant went to the place of the petitioners, they were selling lottery tickets and compelled the de facto complainant to buy the lottery tickers and also abused in filthy language and threatened him with dire consequences.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case.

4.The learned Additional Public Prosecutor would submit on instruction that the totally there are 3 accused and the petitioners are arrayed as A1 and A2 in this case. He also submitted that from A1 a sum of Rs.320/- and a white paper wherein lottery tickets numbers have been written and he is having one https://hcservices.ecourts.gov.in/hcservices/

previous case in Crime No.17 of 2014 and A2 is having three similar type of previous cases in Crime No.546 of 2015, 18 of 2016 and 184 of 2016. He further submitted that investigation is pending. 5.Considering the facts and circumstances of the case and considering the fact that the sale amount was recovered from A1 and the petitioners are having previous case of similar type of offence, this Court not inclined to grant bail to the petitioner at this stage. Accordingly, this Criminal Original petition is dismissed.
