ORDER

The present petition has been filed for issuance of Writ of Mandamus directing the respondents 1 to 3 to grant permission and necessary police protection to conduct Maha Shivaratri festival scheduled to be held on 24.02.2025 to 28.02.2025 at "Sri Angaleswari, Sri Valagurunarhar, Sri Archanamoorthy and Sri Sangili Karuppasamy Kovil" situated at Santhaiyur Village, Peraiyur Taluk, Madurai District pursuant to petitioner's representation, dated 03.02.2025.

According to the petitioner, the petitioner decided to conduct Maha Shivaratri festival in the above said Temple from 24.02.2025 to 28.02.2025 but the private respondent No.5 causing disturbance to the peaceful conduct of festival. Therefore, the petitioner approached the respondents 1 to 3 for granting permission and necessary police protection through representation, dated 03.02.2025 but the same has not been considered. Hence, the petitioner filed this petition.

3. The learned Additional Public Prosecutor appearing for the respondents 1 to 3 would submit that already they received the representation of the petitioner. Thereafter, the third respondent sent a letter to the Revenue Divisional Officer, Usilampatti, Madurai District for conducting peace meeting and the same is pending with the Revenue Divisional Officer.

The learned Government Advocate appearing for the fourth respondent would submit that though the third respondent has referred the matter to the Revenue Divisional Officer, Usilampatti, the petitioner has not impleaded the RDO as party instead they impleaded only the Tahsildar, Periayur Taluk. 3/6

However, the learned Government Advocate appearing for the fourth respondent fairly conceded that the RDO will conduct Peace Committee Meeting after affording opportunities to both the parties and will dispose the request of the third respondent on or before 21.02.2025.

Since the representation of the petitioner was considered by the third respondent and now the matter is under enquiry by the Revenue Divisional Officer, Usilampatti, Madurai and as per the representation of the learned Government Advocate appearing for the fourth respondent, this Court directs the revenue authorities (i.e.,) Revenue Divisional Officer, Usilampatti to dispose the proceedings of the Peraiyur Police Station LIR No.72 of 2024 under Section 126 of B.N.S.S on or before 22.02.2025.

6. With the above said observations and directions, this writ petition stands disposed of. There shall be no order as to costs. 18.02.2025 NCC : Yes / No Index : Yes / No Internet : Yes BTR 4/6
