ORDER : The Court Made the following order :- The petitioner/ accused with rank not known apprehends arrest at the hands of the Inspector of Police, District Crime Branch, Madurai District for the offences punishable under Sections 406 and 420 of IPC in Crime No.
Not known of 2018, seeks anticipatory bail. 2.The petitioner was employed in Osiz Technologies Private Limited, from February 2016 to January 2018. He has now resigned from that company and started his own Enterprise. Erstwhile employer has given complaint against the petitioner herein to the effect that he has stolen away some software and other computer programmes.
3.The learned counsel appearing for the petitioner would submit that such complaint has been falsely given out of the business rivalry and motive. According to the petitioner's counsel since the petitioner has come out of the service of the earlier company, in order to discourage him from setting up a rival business, this complaint has been given.
4.The learned Government Advocate(Crl Side) submits that only the enquiry is pending. However, the petitioner apprehends that at any time, the First Information Report may be registered and he may be arrested; eight hard disks had also been taken away by the police from the custody of the petitioner; the petitioner has been been https://hcservices.ecourts.gov.in/hcservices/
appearing before the police and that the petitioner extended his fullest co-operation.
5.Recording this submission, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate Court No.1, Madurai and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
