PRAYER:- For Bail in Crime No.39 of 2016 on the file of the respondent herein. ORDER:- The Court made the following order:- The petitioner / first accused herein, who was arrested on 04.04.2023, in pursuant to NBW issued by the learned II Additional District & Sessions Judge, 1/3

Thanjavur, in SC No.27 of 2017, connected in Crime No.39 of 2016, the alleged offence under Section 302, 201, 342, 506(ii) of IPC, on the file of the respondent police, seeks bail.

2. The petitioner herein is arrayed as A1 in S.C.No.27 of 2017. He got regular bail and appeared before the trial court regularly. Thereafter, he failed to appear before the trial Court and NBW was issued against the petitioner. The same was recalled by him. Again, due to absence of the petitioner, NBW was issued by the trial Court on 22.09.2022 and the same was executed, by remanding the petitioner to judicial custody on 04.04.2023. Ever since from the date of arrest, the petitioner is in custody.

3. Learned counsel for the petitioner would submit that now the matter is posted for arguments and for undertaking personal work he may be granted 15 days interim bail. The petitioner is facing serious charges under Section 302 of IPC. The trial itself is over and the judgment is going to be pronounced after hearing the arguments. At this time, this application is filed without any valid reasons. He already absconded, warrant was executed. Now the trial is also over. I find absolutely no the reason assigned by the revision petitioner for bail is not acceptable.
