O R D E R

The petitioner has approached this Court seeking issuance of a writ of mandamus directing the respondent to process and consider her application for issuance of a passport dated 08.07.2025, pending in File No.TR2065299095725.

2.The case of the petitioner is that she was born in Dubai on 11.05.1977 while her father was employed there. According to the petitioner, she subsequently returned to India along with her parents and has since been issued various public documents, including an Aadhaar Card, Family Card and Voter Identity Card. The petitioner thereafter applied for issuance of a fresh passport.

3.It appears that the respondent has not processed the petitioner's application on the ground that the date of birth of the petitioner's mother is reflected in her Aadhaar Card as 28.07.1968, whereas the petitioner's date of birth is shown as 11.05.1977. According to the respondent, the said entries give rise to an apparent inconsistency, as the petitioner is 2/5

shown to have been born when her mother was only about eleven years of age.

4.Learned counsel for the petitioner submits that the date of birth of the petitioner's mother has been erroneously recorded in the Aadhaar Card and that steps have been taken to secure correction of the said entry. It is further submitted that the petitioner is willing to furnish the corrected Aadhaar Card of her mother before the respondent for consideration of her passport application.

5.Learned Central Government Standing Counsel appearing for the respondent fairly submits that if the petitioner produces the corrected Aadhaar Card of her mother, the respondent would consider the petitioner's application for issuance of a passport in accordance with law. 6.In view of the above submission, no further adjudication is required in the present writ petition. Accordingly, the writ petition stands disposed of, directing the petitioner to furnish the corrected Aadhaar Card of her mother before the respondent.

7.Upon production of the corrected Aadhaar Card, the respondent shall not reject the petitioner's application solely on the basis of the discrepancy noted in the mother's date of birth and shall proceed to consider the application in accordance with law, subject to verification of the petitioner's credentials and fulfillment of other statutory requirements.

8.The aforesaid exercise shall be completed within a period of four

(4) weeks from the date of receipt of the corrected Aadhaar Card and other requisite documents from the petitioner. 9.There shall be no order as to costs.
