O R D E R

This writ petition has been filed seeking the issuance of a writ of mandamus, directing the first respondent to cancel the assignment patta issued in favor of the third respondent in Ni.Mu.Na.Ka.A1/2851/2019, Vee.Maa.O.No.230/2019 dated 16.08.2019 issued by the second respondent and to restore the assignment patta granted to the petitioner vide E.1.8884/95 dated 30.09.1995.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing on behalf of the respondent.

3. The petitioner submits that a free house site patta was granted in Plot No. 37 in New Survey No. 346/2C, Endapuli Village, Virudhunagar District. The grievance of the petitioner is that the second respondent once again granted an assignment patta in favour of the third respondent herein, vide proceedings dated 16.08.2019. Aggrieved by the same, the present writ petition has been filed.

The learned Additional Government Pleader, appearing on behalf of respondents 1 to 3, submitted that the first respondent would conduct an inquiry, after issuing notice to the petitioner and the third respondent and conclude the same on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

Recording the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to conduct an inquiry after affording a reasonable opportunity to the petitioner, the third respondent and all other persons who may be affected by such decision during the course of the inquiry.
