Respondents/Complainants PRAYER: Petition filed under Section 482 of the Criminal Procedure Code to direct the respondents 1 to 4 therein to transfer the investigation of the above case in Crime No 64 of 2015 from the file of the fifth respondent police to CB CID or any other suitable investigating agency and pass such other orders as this Court may deem fit and proper in the circumstances of the case.

ORDER

This petition has been filed under Section 482 Cr.P.C., seeking a direction to the respondents 1 to 4 therein to transfer the investigation of the above case in Crime No 64 of 2015 from the file of the fifth respondent police to CBCID or any other suitable investigating agency.

2.Heard the learned counsel for the petitioner and the learned Government Advocate(Crl.side) appearing for the State and also perused the status report filed by the fifth respondent.

3. Considering the rival submissions of the learned counsel for the petitioner that the petitioner has been unduly harassed by the respondent police to inform loss of jewelry lesser than that what actually lost as also the status report of the respondent police which informs of alteration of F.I.R pursuant to further information had from the petitioner and his daughter that as many as 73 sovereigns of gold was involved and that the entire gold of 73 sovereigns have been recovered pursuant to the arrest of several accused persons, this Court does not consider it appropriate to transfer the investigation. However, the jurisdictional Deputy Superintendent of Police, is directed to monitor the investigation.

4.The Criminal Original Petition is disposed of with the above direction.
