ORDER

This criminal original petition has been filed to to direct the Special Court for SC/ST (Prevention of Atrocities) Act, Theni District, to consider the surrender and Bail application filed by the petitioners in Crime No.81 of 2026 pending on the file of the 2nd Respondent police and to consider the bail to the petitioners on the same day.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. Gist of the case:

The third respondent/defacto complainant had done intesrcaste marriage with the first petitioner's daughter without consent from their parents. Due to which, the first petitioner is refused to accept them with his family. In such circumstances, on 05.07.2025, the petitioner's father was died. Hence, the wife of the third respondent/defacto complainant attended the funeral. Thereafter, on 07.07.2025, the petitioners called the third respondent/defacto complainant's wife to live together as a join family. On believing the same, on 06.08.2025 the third respondent/defacto complainant's wife went to the petitioner's house. At that time, the second petitioner abused the third respondent/defacto 2/4

complainant's wife in filthy language and attacked her. Due to which, the third respondent/defacto complainant lodged a complaint before the respondent police against the petitioners and the same was registered in Crime No.81 of 2026. Hence, the petition.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

5. Considering the limited scope of the relief sought for, this Court hereby direct the second respondent police to issue prior notice to the de facto complainant and thereafter, to consider the bail application of the petitioners on the same day of his surrender before that Court in connection with Crime No. Crime No.81 of 2026 on the file of the 2nd respondent police. The petitioners shall surrender before the learned Trial Court within a period of 15 days from the date of receipt of a copy of this order.
