PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of MANDAMUS directing the Respondents 1 to 3 to restraining the 4th respondent from interfering in the construction work and day to day administration of the temples namely Arulmighu Porpanaikottai Muneeswarar and Porpanaikottai Veppangudi Village, Alangudi Taluk, Pudukkottai District based on the Petitioner's representation dated 07.01.2026. O R D E R

This Writ Petition is filed seeking a direction to the respondents 1 to 3 restraining the 4th respondent from interfering in the construction work and day to day administration of the temples namely Arulmighu Porpanaikottai Muneeswarar and Porpanaikottai Veppangudi Village, Alangudi Taluk, Pudukkottai District based on the Petitioner's representation dated 07.01.2026.

2. By consent, this Writ Petition is taken up for final disposal at the admission stage itself. Since no adverse order is going to be passed against the 4th respondent, notice to him is dispensed with.

The learned counsel appearing for the petitioner would submit that since the 4th respondent is interfering with the construction work carried out by the respondents 1 to 3 and the day to day administration of the subject temple, the petitioner sent a representation on 07.01.2026 seeking to restrain the 4th respondent from interfering with the construction work. Since the said representation was not considered till date, the petitioner has filed this Writ Petition.

The learned Special Government Pleader appearing for the respondents 1 and 2 would submit that no representation was received by the respondents till date and there is a dispute with regard to the poojariship between the petitioner and the 4th respondent. Under these circumstances, it is not proper for the petitioner to file the present Writ Petition and ask for direction directing the respondents 1 to 3 to restrain the 4th respondent from interfering with the construction works. Hence, he prays for dismissal of this Writ Petition. 3/6

5. The learned counsel appearing for the third respondent would submit that this is the 16th writ petition, and that the petitioner and the 4th respondent have already filed 15 writ petitions arising from their dispute regarding the poojariship.

6. This Court heard the submissions made by the learned counsel appearing on either side and perused the materials available on record.

7. On a perusal of the records, it is seen that there is a private dispute between the petitioner and the 4th respondent with regard to the poojariship. With regard to the said dispute, the 4th respondent has filed a suit in O.S.No.914 of 1993 for permanent injunction and the same is pending. The petitioner has also filed a suit in O.S.No.238 of 2006, for restraining the 4th respondent from claiming poojariship and the same was dismissed. As against the same, the petitioner has filed an appeal suit in A.S.No.16 of 2013, before the Principal District Judge, Pudukkottai. Since the civil suits filed by the petitioner and the respondent are pending before the civil Court, the rights of the parties 4/6

shall be decided only in the said civil suits. Therefore, the relief sought by the petitioner cannot be granted by this Court, and the petitioner is at liberty to approach the civil Court for appropriate relief.

8. Accordingly, this Writ Petition is dismissed. There shall be no order as to costs.

9. According to the third respondent, this is the 16th Writ Petition. Therefore, in future, if the petitioner or the 4th respondent are filed any Writ Petitions before this Court without approaching the civil Court, they shall be liable to pay a sum of Rs.1,60,000/- each as costs. The HR & CE Department is directed to bring to the notice of this Court the payment of costs, if in future the petitioner or the respondents file any writ petition.
