ORDER

This Writ Petition is filed seeking a Writ of Mandamus directing the respondents 1 and 2 to conduct the survey by demarcating the boundary line between Survey No.510/8A and Survey No.510/9, situated at Narasingapuram Village, Athoor Taluk, Dindigul District, within a time frame to be fixed by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the third respondent, notice to the third respondent is hereby dispensed with.

4. The learned counsel for the petitioner would submit that the petitioner is the absolute owner of the subject property and is in peaceful possession and enjoyment of the same. It is further submitted that the petitioner made several representations, including a representation dated 27.01.2026 before the competent authorities, seeking survey and fixation of boundaries in respect of the said

property. Despite receipt of the said representations, no further effective steps have been taken by the authorities. Hence, the petitioner has been constrained to file the present Writ Petition seeking appropriate directions to enable the authorities to conduct the survey and fix the boundaries.

5. The learned Special Government Pleader appearing for the respondents 1 and 2 would submit that proper steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.

Recording the aforesaid submission, this Court directs the respondents 1 and 2 to consider the petitioner's representation dated 27.01.2026 and demarcate the subject property, after considering the claims of the petitioner, the third respondent and any other rival parties, if any, and to pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court.

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
