JUDGMENT

[Judgment of the Court was made by N.SATHISH KUMAR, J.) Challenging the order of the learned Single Judge dismissing the writ petition in W.P.(MD) No.13375 of 2022 dated 04.12.2025, the present writ appeal has been filed.

2. The appellant was initially appointed as a part-time employee in a school. Under G.O.Ms.No.116, School Education Department, dated 05.08.2011, her services were regularised with effect from the date of the said Government Order. The appellant had earlier filed W.P.(MD) No.10307 of 2012 seeking a writ of mandamus to regularise her services from the date of her initial appointment, i.e., 23.12.1991. The said writ petition was dismissed on 07.02.2018. Aggrieved by the same, she preferred W.A.(MD) No.363 of 2019, which was also dismissed 2/6

by the Hon'ble Division Bench on 06.07.2021, with an observation that it was open to the Government to take a decision in the matter. Thereafter, the appellant submitted a representation dated 29.11.2021, which came to be rejected on 27.12.2021. Challenging the said rejection, the appellant filed the present writ petition. The learned Single Judge dismissed the writ petition on the ground that the Government Order under which the appellant's services were regularised clearly stipulates that such regularisation takes effect only from the date of the Government Order. Without challenging the said Government Order, the writ petition was not maintainable. Furthermore, the appellant's earlier attempt to seek regularisation from the date of initial appointment had already failed in the previous round of litigation.

3. Aggrieved by the dismissal, the appellant has filed the present writ appeal.

4. The petitioner now seeks parity with other employees in the matter of regularisation. However, it is admitted that the petitioner was only a part-time employee and was not appointed in accordance with any recruitment rules. Her 3/6

initial appointment itself was not made following due procedure. The petitioner had already challenged the issue by filing W.P.(MD) No.10307 of 2012 seeking regularisation from 23.12.1991, and the writ appeal therefrom was also dismissed on 06.07.2021. Thereafter, she submitted a fresh representation, which was rejected, leading to the filing of the present writ petition.The learned Single Judge dismissed the writ petition on the ground that the same relief cannot be sought repeatedly, as the matter had already attained finality and cannot be reopened merely by submitting a representation.

5. We find no error in the order of the Writ Court warranting interference. Accordingly, the writ appeal is dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
