ORDER

This Writ Petition has been filed seeking a direction to the first respondent to dispose Appeal No.Na.Ka.A/4/1918/2023, dated 16.11.2023.

2. With the consent of both sides, this Writ Petition is disposed of, at the admission stage itself.

3. Since no adverse orders are going to be passed against the respondents 2 and 3, notice to the respondents 2 and 3 is hereby dispensed with.

4. The learned counsel for the petitioner submits that the second respondent initiated proceedings on 16.11.2023 against the petitioner and the third respondent before the first respondent with regard to a registered lease agreement dated 06.05.2022, bearing Document No. 1038 of 2022. The petitioner has filed his counter as early as on 25.12.2023; however, the appeal remains pending without any progress. Therefore, the petitioner has approached this Court, seeking early disposal of the appeal, dated 16.11.2023.

5. The learned Special Government Pleader appearing for first respondent submits that the first respondent will consider the appeal filed by the second respondent, on merits and pass appropriate orders in accordance with the law, within a time frame to be fixed by this Court.

6. Heard the learned counsel appearing for the parties.

7. Considering the above said submissions, there shall be a direction to the first respondent to consider the appeal filed by the second respondent, dated 16.11.2023, on its own merits and pass appropriate orders in accordance with law, after giving due opportunity to the petitioner and the respondents 2 and 3, as well as all other persons, who may be interested in the subject matter, within a period of one month from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the first respondent to consider the same on its own merits.

8. With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs.
