ORDER
Seeking direction to the first respondent to implement the order dated 09.04.2025 in Cr.M.P.No.207 of 2025 on the file of the learned Additional District Munsif cum Judicial Magistrate, Sivagiri, this criminal original petition is filed.
2.Consindering that no adverse order is likely to be passed against the private respondents, notice to them is dispensed with. 3.The learned counsel for the petitioner submitted that the petitioner had preferred a complaint on 01.12.2024 before the first respondent police seeking action against the respondents 2 to 5 for allegedly abusing him in filthy language and forcibly snatching a threesovereign gold chain from him on 10.11.2024. Since no action has been taken on his complaint, the petitioner has sent a representation on 18.12.2024 to the Superintendent of Police, Tenkasi, through post. Thereafter, the petitioner has filed a petition under Section 175(4) of BNSS, in Cr.M.P.No.207 of 2025 before the learned Additional District 2/5
Munsif cum Judicial Magistrate, Sivagiri, seeking direction to the first respondent to register FIR against the private respondents based on his complaint dated 01.12.2024. The learned Judicial Magistrate, by order dated 09.04.2025, directed the first respondent to conduct enquiry on the petitioner's complaint and register FIR on or before 09.05.2025. However, so far, the first respondent police has not complied with the same. Hence, this petition.
4.The learned Government Advocate (Crl.side), on instructions, submitted that pursuant to the order of the trial Court, enquiry was conducted and closure report has also been filed before the trial Court, after serving the same upon the petitioner.
5.Recording the same, this Criminal Original Petition is closed with liberty to the petitioner to file a private complaint. 16.02.2026 NCC : Yes / No Index : Yes / No Rmk 3/5
