PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the respondent to issue 'Non Traceable Certificate' of original Gift deed bearing Document No.899/1989 dated 18.05.1989 on the file of Sub Registrar Office, Nagal Naickanpatti, Dindigul based on the petitioner's representations dated 11.01.2022 and remainder representations dated 13.01.2022 and 19.01.2022 submitted in person within the time limit. ORDER

This petition has been filed to direct the respondent to issue 'Non Traceable Certificate' of original Gift deed bearing Document No.899/1989 dated 18.05.1989 on the file of Sub Registrar Office, Nagal Naickanpatti, Dindigul based on the petitioner's representations dated 11.01.2022 and remainder representations dated 13.01.2022 and 19.01.2022 submitted in person within the time limit.

2. The petitioner's husband owned a property situated in Door No.73A, Nagal Nagar, 6th Ward, Dindigul Town and the same was gifted in favour of the petitioner by a gift deed dated 18.05.1989 registered vide document no.899 of 1989. In order to avail loan by giving mortgage in respect of the subject property she went to xerox shop and she lost the same in the shop. Therefore she has lodged the complaint and it is pending on the file of the respondent police.

3. The learned Additional Public Prosecutor would submit that the petitioner has lodged complaint and he did not co-operate for enquiry.

Crl.O.P.(MD) No.4291 of 2022 for enquiry conducted by the respondent police after publication of public notice and after following the due process of law , the respondent police is directed to issue non traceable certificate to the petitioner within a period of two weeks from the date of receipt of a copy of this order. It is made clear that the respondent police is directed to verify whether said document has not been deposited for any purpose.

5. With the above direction, this Criminal Original Petition stands disposed of.
