ORDER

This Criminal Original Petition has been filed by the petitioner to direct the learned Judicial Magistrate, Nilakottai, Dindigul District to 1/4

expedite the case in C.C. No. 203 of 2023 and dispose of the same as expeditiously as possible.

2. The learned counsel appearing for the petitioner would submit that the petitioner is the defacto complaint in this case and a case has been registered in Crime No.19 of 2022 for the offences under Sections 294(b), 420 and 506(1) of IPC and Sections 3 and 4 of TN Prohibition of Charging Exorbitant Interest Act, 2003. Thereafter, the respondent police have filed final report and the Trial Court has also taken cognizance in C.C.No.203 of 2023. Though the F.I.R has been registered in the year 2022 and cognizance has been taken in the year 2023, so far the trial has not been commenced and the case is pending without any progress. Therefore, he has filed this petition.

3. The learned Government Advocate (Criminal Side) appearing for the respondent would submit that now the case is posted for examination of witnesses and they will produce the witnesses as directed by the Trial Court, and they will cooperate for the speedy disposal of the case.

4. Considering the date of F.I.R and the case is pending from the year 2022 and also considering the nature of offence, this Court inclined to direct 2/4

the learned Judicial Magistrate, Nilakottai Dindigul District to dispose the case in C.C.No.203 of 2023 as early as possible without granting long adjournments beyond the period of fifteen days, preferably within six months from the date of this order.

5. With the above said direction, this Criminal Original Petition stands disposed of.
