O R D E R

This Transfer Civil Miscellaneous petition is filed by the petitioner / wife seeking to transfer H.M.O.P.No.1309 of 2019 on the file of the Family Court, Madurai, Madurai District, to the Family Court, Theni, Theni District.

2. On the side of the petitioner, it is stated that the petitioner / wife is now residing at Theni. She has to take care of her two children. The respondent / husband has filed a petition in H.M.O.P.No.1309 of 2019 on the file of the Family Court, Madurai, Madurai District and prayed the case to be transferred to Family Court, Theni, Theni District.

3. The petitioner being a lady, has to take care of her two children and could not travel to Madurai to attend the Court hearings. No prejudice will be caused to the respondent. Hence, in the interest of justice, the case pending before the Family Court, Madurai, Madurai District, in H.M.O.P.No.1309 of 2019 is withdrawn and is transferred to the Family Court, Theni, Theni District

4. The Family Court, Madurai, Madurai District, is directed to transmit the entire records in H.M.O.P.No.1309 of 2019 to the Family Court, Theni, Theni District.

5. The Family Court, Theni, Theni District, is hereby directed to issue summon to the respondent, after the case is transferred and renumbered.

6. With the above directions, this Transfer Civil Miscellaneous Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
