The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 316(2) and 318(4) of BNS 2023, in Crime No.37 of 2026 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner being a advocate, cheated a sum of Rs. 80,00,000/- from the defacto complainant. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) opposed for grant of anticipatory bail to the 2/4

petitioner.

5. The petitioner is the sole accused. He is an advocate. According to the petitioner, the defacto complainant is the petitioner's client. Being an advocate, he cannot have any money transaction with the client and do not cheat the client, which is totally against the Advocates Act. Considering the same, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 12.02.2026 PJL TO
