Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 420 of IPC, in Crime No.Not Known of 2017, on the file of the respondent police seeks anticipatory bail.
2.The case of the prosecution is that the petitioner while working as a Field Project Officer in Mannar Biosphere Reserve, Thangachimadam Village Ramanathapuram District, collected monthly payment from the self help groups. The said collection was not paid to the trust. He misappropriated the money to the tune of Rs.6,00,000/- and after Audit objection, the said illegal activity was came to light. Thereafter, the Regional Officer, Mr.R.Raghuvaran gave a complaint before the respondent police for which the present anticipatory bail petition is filed.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and prays for anticipatory bail.
4. The learned Government Advocate (Criminal side) appearing for the respondent submitted that admittedly the petitioner is working as Field Project Officer in the year 2008 to 2014 and he https://hcservices.ecourts.gov.in/hcservices/
collected a huge amount from 24 self help groups to the tune of Rs.6,00,000/-, which was not deposited to the proper account of the trust and thus he misappropriated the amount and till date, the petitioner did not return any amount as on date.
5. Considering the facts and circumstances of the case and since the petitioner being a public servant, misappropriated money from 24 self help groups to the tune of Rs.6,00,000/- and considering the gravity of the offence committed by the petitioner, I am not inclined to grant anticipatory bail to the petitioner.
