Selvakumar v. Rathidevi
BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT Dated : 18.02.2026
CORAM
THE HONOURABLE MR. JUSTICE N.SENTHILKUMAR C.R.P(MD). No.441 of 2026 and C.M.P(MD) No.1979 of 2026 Selvakumar ... Petitioner Vs Rathidevi ... Respondent PRAYER :-Civil Revision Petition filed under Article 227 of the Constitution of India, to set aside the order dated 12.06.2025 passed in I.A.No.1 of 2024 in H.M.O.P.No.248 of 2023 on the file of the Principal Sub Court, Tenkasi and allow this Civil Revision Petition. For Petitioner : Mr.K.Raghul Priyan
ORDER
This Civil Revision Petition has been filed challenging the order passed in I.A.No.1 of 2024 in H.M.O.P.No.248 of 2023 on the file of the Principal Sub Court, Tenkasi, dated 12.06.2025, whereby the learned 1/4
Judge directed the petitioner to pay a sum of Rs.7,000/- per month towards maintenance and litigation expenses and a further sum of Rs.7,000/- per month towards the educational expenses of his child, till the disposal of the H.M.O.P.
2. The learned counsel for the revision petitioner submitted that the petitioner is employed in a private company and is earning only a meagre salary, whereas the respondent is a woman of sufficient means and is capable of maintaining herself and the child. It was further contended that the trial Court has not followed the dictum of the Hon'ble Supreme Court in obtaining the assets and liabilities statements from both parties before passing the impugned order.
3. This Court is of the view that even assuming that such a contention is taken into consideration, the quantum awarded by the trial Court, namely Rs.7,000/- towards maintenance and Rs.7,000/- towards educational expenses, cannot be said to be excessive. On the contrary, the amount awarded appears to be reasonable and in fact, modest, considering the present cost of living.

4. In such circumstances, this Court does not find any ground to interfere with the order passed by the trial Court. However, it is made clear that the contentions raised by the revision petitioner are left open to be considered by the trial Court at the time of final disposal of the H.M.O.P.
5. Accordingly, this Civil Revision Petition is dismissed for want of merits. Consequently, the connected Miscellaneous Petition is closed. No costs.
