Respondent PRAYER: The Petition filed under Section 439(1)(b) Cr.P.C., to modify the condition imposed in Crl.M.P.(MD)No.2117 of 2017 dated 28.07.2017 by the learned Principal Sessions Judge, Thanjavur in respect of one of the condition that the petitioners should deposit a sum of Rs.25,000/- each.

The learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the respondent Police are present.

2.This petition is filed to modify the condition imposed in Crl.M.P.(MD)No.2117 of 2017 on 28.07.2017 by the learned Principal Sessions Judge, Thanjavur directing the petitioners to deposit a sum of Rs.25,000/- each.

3.The petitioners were charged under Sections 498(A), 406, 506(ii) r/w 109 IPC and Section 4 of Dowry Prohibition Act, 1961. 4.The learned counsel for the petitioners submitted that due to poverty, the petitioners are not able to comply with the above said condition.

5.Considering the facts and circumstances of the case and also considering the charges levelled against the petitioners, who are in-laws of the de facto complainant, this Court is inclined to modify the condition of depositing the amount. Accordingly, the condition of depositing a sum of Rs.25,000/- each is deleted in Cr.M.P.No.2117 of 2017 dated 28.07.2017. In respect of compliance https://hcservices.ecourts.gov.in/hcservices/

of the other conditions, one week time is granted from the date on which the other copy is made ready. This Criminal Original petition is ordered accordingly.
