ORDER

The petition has been filed to direct the respondents to provide the effective police protection to the petitioner company to erect transmission towers at Pudukottai District & Taluk in Pudukottai Municipal Limit in Pudukottai Town in Thiruvalluvar Nagar, 4th Veethi, in T.S.No.7795/Part, in Plot NO.106.

2.Heard Mr.K.Govindarajan, learned counsel for the petitioner and Mr.K.V.Rajarajan, learned Government Advocate (Crl. Side)appearing on behalf of the respondents.

3. The learned counsel for the petitioner stated that the petitioner company has entered into a lease agreement with the land owners and obtained necessary permission from the Ministry of Communications, Government of India to erect transmission towers for connectivity and nobody should prevent them as they are not encroaching neighbour's land.

4. The learned counsel for the petitioner drew attention of this Court to the orders of this Court dated 12.09.2014 in Crl.O.P.No.12596 of 2013 batch and in Crl.O.P.No.15093 of 2014 batch. In that cases, this Court directed the police to enquire and give adequate protection and as per the order of this Court, the respondent police had given adequate police protection.

5.Taking note of the submission of the learned counsel for the petitioner, the second respondent police, Deputy Superintendent of Police, Pudukottai Town is directed to give police protection to life and limb of the petitioner. With regard to erection of transmission towers, the second respondent police is directed to give police protection if there are no legal impediments. 6.With the above said direction, the Criminal Original Petition is ordered.
