ORDER : The Court made the following order :- 1/4

The petitioner, who was arrested and remanded to judicial custody on 16.10.2025 for the offences punishable under Sections 329(4), 296(b), 127(2), 309(6), 109, 64 and 351(3) of BNS, in Crime No.142 of 2025 in S.C.No.958 of 2025 on the file of the respondent police seeks bail.

2. The case of the prosecution is that on 04.10.2025 at 7.45 pm the accused trespassed into the house of the defacto complainant when the accused tried to rob the defacto complainant she restrained him. Hence, he provoked and scolded her in filthy language, attacked her by iron box caused blood injuries, robbed her covering chain and 1⁄2 sovereign stud, burned by iron box on her cheek, hand and rapped and criminally intimidated her. Hence the complaint.

3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. side) appearing for the respondent Police.

3. After perusing the 164 statement of the victim, who is approximately 67 years of age, this Court is of the considered opinion 2/4

that the petitioner has committed an absolutely heinous crime. The petitioner has assaulted the 67 years old lady and committed penetrative sexual assault also. The victim was grievously hurt with an iron box and threatened with an aruval. The prosecution has submitted photographs of the injuries, and upon perusal of the same along with the aforementioned facts, this Court is not inclined to grant bail to the petitioner.

4. Accordingly, this Criminal Original Petition is dismissed. (S S Y J) 12.02.2026 TRP TO
