Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 430 and 353 IPC and Section 3 of the Tamil Nadu Property (Prevention of Damage And Loss) Act, 1992, in Crime No.288 of 2014 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the de facto complainant, in this case, is an Engineer, working in Public Works Department, who has lodged a complaint stating that that these petitioners had damaged the water pipelines laid by the Government for supply of water to the village people. It is seen that these petitioners were granted Anticipatory Bail in Crl.OP[MD].No.206 of 2015, by the learned Principal and District Judge, Tirunelveli and after getting Anticipatory Bail, the petitioners did not furnish sureties. Suppressing the above, the present Criminal Original Petition has been filed.
3. Taking into consideration of the nature of the allegations against the petitioners, inasmuch as they have destroyed the water pipelines, this Court is not inclined to grant Anticipatory Bail to the petitioners. Hence, this petition is dismissed.
