COMMON PRAYER: Writ petitions filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents to sanction yearly increment from April, 2017, selection grade from 01.06.2016 and other monetary benefits to the petitioner.

2.By consent of both parties, the main Writ Petitions themselves are taken up for final disposal at the stage of admission itself.

3.The petitioners are working as B.T. Assistants. The grievance of the petitioners is that the incentive increments for acquiring higher qualification were not conferred on them. The Government has issued G.O.(Ms).No.18, School Education Department, dated 18.01.2013 in this regard. The grievance of the petitioners is that the benefit extended by the said G.O, will be given only https://hcservices.ecourts.gov.in/hcservices/

from the date of issuance of the said Government Order. But, in this case, the petitioners were already granted the said incentive increment. Therefore, recovery orders came to be issued. The same was challenged. Interim stay has been granted. The petitions are still pending. In the mean while, citing the pendency of the writ petitions, the annual increments are not being sanctioned. Seeking grant of the annual increments and selection grade notwithstanding the pendency of the petitions filed by them, the petitioners have given representations in this regard.

4.Therefore, the first respondent is directed to consider the petitioners' representations on merits and in accordance with law and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.
