ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 20.06.2017, for the offences punishable under Sections 341, 392, 397 and 506(ii) of IPC., in Crime No.836 of 2017, on the file of the respondent Police, seeks bail.
2. The case of the prosecution is that the petitioner along with other accused snatched the cellphone of the defacto complainant at the knife point.
3. The learned counsel appearing for the petitioner states that the petitioner is an innocent and he has not committed any offence, as alleged by the prosecution and he has been falsely implicated in this case and he is in prison from 20.06.2017
4. The learned Additional Public Prosecutor appearing for the respondent, on instructions, would submit that there are totally two accused in this case and the petitioner herein is arrayed as A1. The earlier bail application moved on behalf of the petitioner in Crl.O.P(MD)No.8861 of 2017 was dismissed by this Court only recently on 24.07.2017. There is no change in circumstances of dismissal of the earlier bail application and the investigation is still pending.
5. Considering the above facts and circumstances of the case and also considering the fact that there is no change in circumstances from dismissal of the earlier bail application and https://hcservices.ecourts.gov.in/hcservices/
also the petitioner is having one similar type of offence and the property viz., Cellphone was recovered from the petitioner herein, this Court is not inclined to grant bail to the petitioner, at this stage.
