O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the first respondent to dispose of the petitioner's appeal in Case File No.19997643/2024, dated 19.02.2024, within a time frame to be fixed by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the private respondents, as no adverse orders are proposed to be passed against them.

3. The grievance of the petitioner is that he is the absolute owner of the property. However, without issuing any notice to the petitioner, the patta standing in his name was cancelled and pattas were issued in favour of the private respondents. Aggrieved by the same, the petitioner preferred an appeal before the first respondent. Though the appeal was taken on file in Case File No.19997643/2024, the same has not been disposed of till date. Therefore, the petitioner has been constrained to file the present Writ Petition.

4. The learned Government Advocate appearing for the first respondent, on instructions, would submit that the petitioner's appeal would be disposed of by the first respondent within a period of sixteen weeks.

5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to consider the petitioner's appeal in Case File No.19997643/2024 and pass appropriate orders on its merits and in accordance with law within a period of sixteen weeks from the date of receipt of a copy of this order. The appeal shall be disposed of after Page No. 3 of 5

conducting an enquiry. The first respondent is also directed to provide a reasonable opportunity of hearing to the petitioner, private respondents and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at liberty to work out their remedies before the competent Civil Court. There shall be no order as to costs.
