The case of the petitioner is that her father-in-law, namely, Nallappa Gounder passed away on 15.01.1985. Subsequently, her husband, namely, Ramasamy Gounder also passed on. The petitioner and her children find the necessity of registering the death of Nallappa Gounder. Hence, they approached the respondents. As no action had been initiated, they have made a representation on 23.01.2025 and approached this Court for mandamus.
2. When the matter came up for admission, the learned Government Advocate states that if an affidavit is filed by the writ petitioner accompanied by an affidavit of neighbors, who were residing at the time of death of Nallappa Gounder regarding his date of death, the 2/5
respondents will consider the application filed by the petitioner for registration of death certificate.
3. Mr.J.Sathiaraj for the petitioner states that an affidavit of the writ petitioner and her children have already been presented to the respondents on 26.04.2024. He had handed over a copy of the said affidavit to the learned Government Advocate. It is assured by the petitioner that affidavits of the neighbours will be filed within a week from today (i.e., 19.02.2025).
4. The learned Government Advocate assures this Court that if an affidavits of the neighbours are given to his clients within a week as stated by Mr.J.Sathiaraj, they will take an appropriate enquiry and pass orders within a week thereafter.
5. Recording the statements of both Mr.J.Sathiaraj and the learned Government Advocate, this Writ Petition is disposed of. No costs. 3/5
