ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 5 r/w 7(3) of Lottery Regulation Act, 1998 r/w Sections 109 and 120 (b) of IPC., in Crime No.917 of 2017, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner herein has supplied lottery tickets and the numbers of which were written in a white papers, for the purpose of sale through A1, A2 in this case and A1 and A2 were arrested and they are in custody.

3. The learned counsel appearing for the petitioner states that the petitioner has not committed any offence what-so-ever and he is an innocent person and he is no way connected with this case.

4. The learned Additional Public Prosecutor appearing for the respondent, on instructions, would submit that there are totally three named accused in this case and the petitioner herein is arrayed as A3. The petitioner herein has supplied lottery tickets and the numbers of which were written in a white papers, for the purpose of sale through A1, A2 in this case and A1 and A2 were arrested and they are in custody. He would further submit that petitioners are having four previous cases of similar type of offence and the investigation is pending.

Considering the above facts and circumstances of the case, and also considering the fact that the petitioner said to have sold lottery tickets and it is banned by the State of Tamil Nadu and the said white papers containing lottery numbers and the sale amount of Rs.350/- were recovered from other co-accused and the petitioner is having four previous cases of similar type of offences and also considering the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner, at this stage.
