O R D E R

1. The petitioner is before this Court challenging the proceedings dated 22.07.2025 issued by the respondent, whereby the petitioner's application for providing an electricity service connection to the house property bearing Door No.1/86, Mammaniyur, Kombaripatti Village, Vedasandur Taluk, Dindigul District, was rejected.

2. It is stated that the petitioner was earlier granted a temporary electricity service connection for the purpose of construction of the house. During the course of construction, two children died due to electrocution. 2/5

The respondent attributed the said incident to the petitioner, and proceedings relating to compensation are stated to be pending.

3. In the above circumstances, the petitioner's application for permanent electricity service connection came to be rejected. The petitioner submits that the construction of the house has now been completed and that he is residing in the said premises without electricity supply. The petitioner has also undertaken to take all necessary precautionary measures to prevent any untoward incident if an electricity service connection is provided.

4. This Court is of the view that, having completed construction and being in occupation of the house, the petitioner cannot be deprived of an electricity connection, which is a basic necessity. The rejection of the petitioner's application, in the facts and circumstances of the case, is therefore arbitrary and unsustainable.

5. Accordingly, this Writ Petition is allowed, and the impugned proceedings dated 22.07.2025 are hereby set aside. The petitioner is directed to submit a fresh application for electricity service connection to the subject property. Upon receipt of such application, the respondent shall consider the same on its own merits and in accordance with law within a period of four (4) weeks from the date of receipt of the application. No costs. Consequently, the connected miscellaneous petition is closed.
