ORDER
This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the second respondent not to harass the petitioner and his family members under the guise of enquiry on the basis of the petitioner's representation, dated 14.02.2023.
2. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the State would submit that the petitioner and the defacto complainant loved each other and by giving false promise, the petitioner had sexual intercourse with her. Now the petitioner refused to marry the defacto complainant. Hence, the complaint. He would further submit that on the basis of the complaint given by the defacto complainant, enquiry was undertaken, during the course of enquiry, the petitioner agreed to marry the third respondent and on the basis, the enquiry was closed. Subsequently, the third respondent has given a complaint to the Superintendent of Police, Ramanathapuram District and the same is still pending for consideration. 2/4
3. In view of the above, the prayer sought for by the petitioner cannot be granted and the second respondent Police is directed to proceed with enquiry in accordance with law.
4. With the above direction, this Criminal Original Petition stands dismissed.
