Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner/sold accused apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b) and 307 I.P.C and Section 3 of TNPPDL Act in Crime No.270 of 2014 and hence, seeks anticipatory bail.

2. The case of the prosecution is that three days prior to the occurrence, there was a wordy quarrel with regard to hiring the auto and on the date of occurrence the petitioner is said to have attacked the defacto complainant and caused injury.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and he has not committed any offence and he has been falsely implicated in this case.

4. The learned Government Advocate(Crl.side)submitted that the defacto complainant has sustained simple injury and he has been discharged from the hospital.

5. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the State and also perused the entire materials available on record. https://hcservices.ecourts.gov.in/hcservices/

6. Considering the facts and circumstances of the case, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Nanguneri, and on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready failing which, the petition for anticipatory bail stands dismissed.
