For 2nd Respondent : Mr.S.Chandrasekar, Additional Public Prosecutor PETITION FOR CANCELLATION OF BAIL Under Sec.439 (2) of Cr.P.C. PRAYER :- To cancel the Bail granted to the first respondent by the learned Judicial Magistrate No.II, Madurai in Crl.M.P.No.409 of 2020 dated 07.02.2020.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent. 2.This petition has been filed for cancellation of bail. The learned Judicial Magistrate, after hearing accused/petitioner as well as the defacto complainant, who intervened in the bail petition, has gone through the material available in the Case Diary file and being satisfied with the same, came forward to release the accused/petitioner on bail on condition.

3.Now, the defacto complainant has filed a petition for cancelling bail stating that the bail was obtained by the accused https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.3770 of 2020 person by suppressing the fact. The learned counsel appearing for the defacto complainant would make attempt to convince this Court that the materials collected by the Police and the materials furnished by him in support of his complaint not properly appreciated.

4.I am afraid that it is not stage to appreciate all the evidences and interfere in a bail petition. Since the Principal Sessions Judge has applied her mind and granted bail and no violation of bail condition brought out to the notice of this Court.
