Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 409, 420, 464, 469 and 471 IPC in Crime No.33 of 2014 on the file of the respondent police, seeks anticipatory bail.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the State.
3. This is third anticipatory bail petition filed by the petitioner. The case of the prosecution is that this petitioner was working as Head Surveyor in the Taluk Office and that he has fabricated bogus revenue records in respect of the lands of the defacto complainant.
4. The respondent police have filed a status report, wherein in Paragraph Nos.4 to 6, they have stated as follows: "4. I submit that, on the investigation conducted and on perusal of documents it was found that, the petitioner has created a forged document as if the Tahsildar (South), Madurai has passed a Proceeding in respect of the properties belonging to the defacto complainants. In this regard the Petitioner has received a sum of Rs.45,000/- from the defacto complainant and cheated them. https://hcservices.ecourts.gov.in/hcservices/
5. I submit that, so far 3 number of persons were interrogated as witnesses and statement under section 161 of the Cr.P.C. has been recorded. Further, the statement of the Tahsildar, Madurai (South) clearly elucidate that the so called proceeding provided by the Petitioner is forged and fake.
6. I submit that, the specimen signature of the Petitioner is necessary for further investigation. But, since the petitioner is continuously absconding for more than 10 months, the investigation process is at stake."
5. In view of the serious nature of allegations against this petitioner, this Court is not inclined to grant him anticipatory bail.
