For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in crime no 1 of 2020 on the file of the Respondent Police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent. 2.The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 8(C) r/w 20(b)(ii) B of NDPS Act in Crime No.1 of 2020 on the file of the respondent police, seeks anticipatory bail.
3.The petitioner apprehending arrest by the respondent police in crime No.1 of 2020 where the respondent police has intercepted one Elangovan on 13.01.2020, based on specific information and recovered 5kg of ganja from his possession. In the confession statement of said Elangovan, the Investigating Officer has came to know that this petitioner is an associator of the accused Elangovan. Out of 5 kg of ganja, 2.5kg ganja to be delivered to this petitioner. Before he deliver the contraband, the police has seized https://hcservices.ecourts.gov.in/hcservices/ 1/2

4.From the confession statement of Elangovan, it appears that the petitioner herein is a processor of the seized contraband. Hence he has been shown as absconding accused. 5.The learned Government Advocate(Crl.side) appearing for the respondent police would submit that the petitioner is a habitual offender and already he is involved in a similar case and now the said case is pending trial in Spl.C.No.158 of 2014 and while he is in bail, he has indulged in the present case. 6.In view of the submissions made by the learned Government Advocate(Crl.side), this Court is of the view that the petitioner is not entitled for anticipatory bail. Hence, this criminal original petition is dismissed.
