Side) appearing for the respondent police.

2.The learned Government Advocate (Crl. Side) appearing for the respondent Police would submit that the petition enquiry pending. 3.The learned counsel appearing for the petitioner would submit that the petitioner sold the property to one Kumar based on the power of attorney under the instruction of the defacto complainant. 4.Nature of the complaint and defence taken by the petitioner herein can be appreciated only during the petition enquiry, which is pending. It is appropriate for the petitioner herein to participate in the enquiry and produce all the documents available with him and cooperate to the enquiry.

CRL OP(MD). No.3753 of 2020 5.It is duty of the respondent police to register a complaint, if any cognizable offence is made out as a result of the enquiry and take a decision whether custodial interrogation of the petitioner is required or not.

5.With the above observation, this criminal original petition is dismissed.
