Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus, directing the respondents to ensure that no person shall bury or burn or cause to be buried or burnt any corpse in S.No. 1519/4 to an extent of 1 acre and 11 cents in Senthamangalam Melpagam Village, Aravakurichi Taluk, Karur District, by considering the petitioners' representation dated 28.09.2023 nor in the public road and further direct the respondents to strictly follow the provisions of the Tamil Nadu village Panchayat (Provision of Burial and Burning Ground) Rules, 1999. ORDER

This Writ Petition has been filed to direct the respondents to ensure that no person shall bury / burn / cause to be buried / burn any corpse in S.No.1519/4, to an extent of 1 acre and 11 cents, Senthamangalam 2/6

Melpagam Village, Aravakurichi Taluk, Karur District, by considering the petitioners' representation dated 28.09.2023, or in the public road and further direct the respondents to strictly follow the provisions of the Tamil Nadu village Panchayat (Provision of Burial and Burning Ground) Rules, 1999.

2. The learned counsel appearing for the petitioners would submit that the petitioners have given a representation on 28.09.2023 to ensure that no person shall bury / burn / cause to be buried / burn any corpse in S.No. 1519/4, Senthamangalam Melpagam Village, Aravakurichi Taluk, Karur District. However, the same is yet to be considered. Hence, the Writ Petition.

3. The learned Special Government Pleader appearing for the respondents 1 to 6 would submit that the representation submitted by the petitioners will be disposed within the time stipulated by this Court.

4. In view of the same, without expressing any opinion on the merits of the matter, this Court directs the third respondent to consider the representation of the petitioners dated 28.09.2023 by affording an opportunity of hearing to them, and thereafter dispose of the same, on its own merits and in accordance with law, within a period of four (4) weeks 3/6

from the date of receipt of a copy of this order. It is made clear that, interim order already granted by this Court shall continue until the disposal of the representation of the petitioners.
