RESPONDENT/RESPONDENT/COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to Relax the condition imposed in Crl.M.P.(MD) No. 6384/2020 in Crl.A.(MD) No. 212/2019 dated 21.12.2020 on the file of this Honourable Court.
Order:This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.K.PRABHU, Advocate for the petitioner and of Mr.R.ANANDHARAJ, Additional Public Prosecutor on behalf of the Respondent, the Court made the following order:- This petition has been filed seeking relaxation of the condition imposed on the petitioner in Crl.M.P(MD)No.6384 of 2020 in Crl.A(MD)No.212 of 2019, dated 21.12.2020. 2.The petitioner was arrayed as A2 in the Sessions Case and he was found guilty for commission of murder along with other accused. This Court suspended the sentence on 21.12.2020 on condition that he shall stay at Krishnagiri and report before the learned Judicial Magistrate No.I, Krishnagiri, daily at 10.30 a.m., until further orders.
3. Mr.K.Prabhu, learned counsel appearing for the petitioner would argue that the petitioner is a poor agriculturists and in view of the condition imposed on him, he is not able to do his regular https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD) No.2070 of 2021 work and his entire family is suffering. It is also submitted that in respect of other accused, this Court directed them to appear before the committal Court once in a month and hence, the condition imposed on the petitioner can be modified.
4. The learned Additional Public Prosecutor appearing for the respondent, on instructions, would state that the petitioner has been complying with the condition from 31.12.2020.
5. In the light of the above submission made by the learned counsels, we are of the opinion that the condition imposed on the petitioner can be modified directing him to appear before the committal Court once in fifteen days I.e., on first and third week of Monday at 10.30 a.m., until further orders.
6. Accordingly, this petition is ordered.
