O R D E R
This writ petition has been filed seeking a direction to the respondents Nos.3 to 5 to complete the proceeding initiated by the 3rd respondent, vide Na.Ka. A4/206/2026, dated 28.01.2026 based on the petitioner's representation as in person on 29.01.2026 and consequent representation dated 05.02.2026 within a stipulated time that may be fixed by this Court.
2. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the official respondents. By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.
3. The petitioner sent a representation to the 3rd respondent to complete the enquiry and cancel the free house site patta issued to 2/5
various beneficiaries in the water channel and pursuant to the issuance of those free pattas for construction of houses, there is obstruction of free flow of water to the nine Kanmois. It is his further case that though enquiry was initiated through proceedings dated 28.01.2026, it has not been concluded. Hence, the petitioner is before this Court.
4. The learned Government Advocate, on instructions, would submit that enquiry would be conducted and it would be concluded at the earliest point of time.
5. It is seen that free house site pattas were issued to the landless poor people. However, those assigned lands are water channels. By issuance of these patta to the beneficiaries, the water channel will get blocked and will affect nine kanmois by obstruction of free flow of water to the kanmois. Hence, the respondents 1 and 2 are directed to find out an alternative place for the beneficiaries. It is submitted that the third respondent has already initiated proceedings to find out whether the lands in question are water channels. If the third respondent comes to the conclusion that the lands are water bodies and since no constructions were made in the said lands, the respondents are hereby directed to 3/5
cancel those free house site pattas and find out alternative places and issue patta afresh for the eligible beneficiaries. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.
6. The writ petition is disposed of with the above direction. No costs. There shall be no order as to costs.
