ORDER

This criminal original petition has been filed to direct the learned Sessions Judge, Special Court for Trial of Cases registered under SC/ST(POA) Act, Trichy District, to consider the bail application to be filed by the petitioners on the same day of its filing on their surrendering in connection with the case in Crime No.54 of 2026 on the file of the Inspector of Police, Manapparai Police Station, Trichy District.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. Gist of the case:

At the instance of the third respondent/defacto complainant, First Information Report in Crime No.81 of 2026 was registered against the petitioners for the offence under Section 296(b), 351(2) of BNS, Section 4 of Tamil Nadu Prohibition of Charging Exorbitant Interest Act, 2003 and Section 3(1)(r), 3(1)(s) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities), with respect to exorbitant money and abuse by degrading the petitioner's caste. Hence, the petition.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the second respondent police to issue prior notice to the de facto complainant and thereafter, to consider the bail application of the petitioners on the same day of his surrender before that Court in connection with Crime No. Crime No.54 of 2026 on the file of the 2nd respondent police. The petitioners shall surrender before the learned Trial Court within a period of 15 days from the date of receipt of a copy of this order.
