High Court's Order dated 28/02/2020 in CRL OP(MD).No.3695 of 2020 The Hon'ble High Court, in its order under reference cited, has directed the Registry to call for a report from the THE JUDICIAL MAGISTRATE, THENI, as to the charge sheet was filed on 11.12.2019, but the accused had surrendered before the said court on 13.09.2019. The bail was granted by the Judicial Magistrate, Theni on 13.12.2019 itself which clearly shows that the charge sheet had been filed before the statutory bail petition. Hence, the question of filing a petition under section 167 of Criminal Procedure Code does not arise. Therefore the Judicial Magistrate, Theni is hereby directed to give his report for the aforesaid lapse where the sequence is not quite clear?

As directed, you namely the THE JUDICIAL MAGISTRATE, THENI is hereby required to submit your report as stated supra, to this Registry on or before 12/3/2020 as the matter stands posted on 13/03/2020.
