The above petitions have been filed seeking orders (i) to set aside the abatement caused due to the death of the third respondent and (ii) to bring on record the proposed respondents 4 to 6 herein on record as legal representatives of the deceased third respondent and rank them as respondents 4 to 6 in the above second appeal.

2.Heard the learned counsel for the petitioners and the learned counsel for the respondents 1 and 3 and also perused the records.

3.The learned counsel appearing for the respondents 1 and 3 would submit that they are not having objections to allow this petition. 4.Being satisfied with the reasons stated in the affidavit filed in support of these petitions, these petitions are ordered and the Registry is directed to carry out necessary amendment in the second appeal and list the matter on 24.02.2026.
