ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders, to direct the respondent police to file a final report in Crime No.8 of 2019 on the file of the Sayalkudi Police Station, for the alleged offences under Sections 147, 294(b), 323 IPC, which was pending before the learned Judicial Magistrate Court, Muthukulathur, Ramanahapuram Distict and file the final report within the time frame as may be fixed by this Court.

2. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the respondent would submit that the respondent, after completing the investigation, has laid the final report dated 12.01.2019 in Crime No.8 of 2019 as 'Mistake of Fact'.

3. At this juncture, the learned counsel appearing for the petitioner would submit that RCS notice was not served on the petitioner/defacto complainant.

4. Recording the submissions made on either sides, the respondent Police is directed to serve RCS notice on the petitioner/defacto complainant and the petitioner is at liberty to workout his remedy by appropriate proceedings.

5. With the above direction, this Criminal Original Petition stands disposed of.
