ORDER

This Criminal Original Petition has been filed to transfer the investigation of the case in Crime No.33 of 2023 on the file of the 3rd respondent to some other competent investigation officer by considering the complaint of the petitioner dated 21.01.2023, and to file a Charge Sheet.

2. When the matter is taken up for hearing today, the learned Government Advocate would submit that already the matter has been investigated and final report has been filed as 'Mistake of Fact' and RCS notice has also been served to the defacto complainant.

3. Per contra, the learned counsel for the petitioner would submit that he has not yet served any notice regarding to closure of the complaint.

4. Today, a copy of the closure report was served to the learned counsel for the petitioner.

In view of the same, no further orders is required to be passed in this case and the Criminal Original petition stands closed with liberty to the petitioner to approach the appropriate forum if he is aggrieved over the closure of the complaint. Consequently connected miscellaneous petition stands closed.
