2.The petitioner/appellant submits that the first respondent remained exparte before the Court below and the notice sent to the first respondent was returned with an endorsement 'no such addressee'. Therefore, the first respondent is given up in the petition and endorsement is made to that effect. 3.The learned counsel for the third respondent has no objection to the petition being allowed.
