PRAYER: Habeas Corpus Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, to direct the respondents 3 and 4 to produce the body or person of the detenue/the petitioner's son namely Arulvalan, S/o.Susai Jeyamani, aged about 25 years who is illegally detained by the unknown person before this Court and set him at liberty. ORDER
(Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) This petition is filed to direct the third and fourth respondents to produce the body or person of the detenue/the petitioner's son, namely Arulvalan, S/o.Susai Jeyamani, aged about 25 years, who is illegally detained by the unknown person before this Court and set him at liberty. 2.The case of the petitioner is that the petitioner's son viz., Arulvalan, who was aged about 25 years old, had gone to work on 19.04.2024 and has not returned home. The petitioner had loged a complaint to the police on 28.09.2024. Since the respondent police have not take any action to find out the whereabouts of the missing person, the petitioner has filed the present Habeas Corpus Petition. 2/6
3.The fourth respondent has filed a Status Report. 4.The learned Additional Public Prosecutor appearing for the respondents, on instructions, submitted that the petitioner's son went missing on 19.04.2024, based on which, a case in Crime No.244 of 2024 was registered on the same day. The learned Additional Pubic Prosecutor further submitted that the petitioner's son was suffering from psychiatric problem and he was undergoing treatment. On an earlier occasion, the petitioner's son Arivalagan went missing on 10.02.2024 and on the complaint given by the petitioner, a case in Crime No.30 of 2024 was registered under "Man Missing" and during the course of investigation, the petitioner informed that his son had returned back home.
The petitioner's wife had brought his son for enquiry and he had stated that he was staying and working at Sathuragiri. Recording the statement of the petitioner's son, further action was dropped in Crime No.30 of 2024. Likewise, the petitioner's son had once again gone missing on 19.04.2024. However, a complaint was given by the petitioner to the respondent police only on 28.09.2024 and based on the complaint, the second case in Crime No.244 of 2024 was registered under "Man missing".
have stated the details in the Status Report. Further, the respondent police have got information that the detenue was roaming around hills areas of Sathuragiri at Virudhunagar. The respondent police are taking steps to secure the missing person. The respondent police are continuing with the investigation in the Crime No.244 of 2024 to secure him at the earliest. 5.Taking into consideration of the aforesaid submissions and also the Status Report filed by the fourth respondent, this Habeas Corpus Petition stands closed with a direction to the fourth respondent to continue with the investigation and to trace the missing person. The Deputy Superintendent of Police, Alangulam SubDivision, is directed to monitor the investigation in Crime No.244 of 2024 and ensure that the missing person is traced. The petitioner shall also cooperate with the investigation.
