P.Menaka, v. The District Collector,
BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT Dated : 22.01.2018 CORAM :
THE HONOURABLE MR.JUSTICE G.R.SWAMINATHAN W.P(MD)No.67 of 2018 and W.M.P.(MD) Nos.61 & 62 of 2018 P.Menaka .... Petitioner Vs.
1.The District Collector, Trichy District, Trichy.
2.The Tahsildar, Lalgudi Taluk, Trichy District.
... Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records relating to the order No.Na.Ka.A4/14333/2017, dated 16.08.2017 passed by the first respondent and quash the same and consequently, direct the respondents to grant regular appointment to the petitioner, on the basis of the petitioner's qualification under compassionate grounds within a time limit.
For Petitioner : Mr.T.Sakthikumaran for Mr. A.Thirumurthy For Respondents : Mr.J.Gunaseelan Muthaiah, Additional Government Pleader

The writ petitioner's father passed away in the year 1988. The application seeking appointment on compassionate ground was submitted only in the year 2012. The said application was rejected by order dated 16.08.2017 by the first respondent. The same is under challenge in this writ petition.
2.The learned counsel appearing for the writ petitioner reiterated the grounds pleaded in the writ petition. This Court is of the view that the first respondent rightly rejected the writ petitioner's application. When the death of the petitioner's father https://hcservices.ecourts.gov.in/hcservices/
took place in the year 1988 and an application for compassionate appointment was not lodged in time, the question of considering the same does not arise. An application for compassionate appointment must be lodged within a period of three years from the date of death of the Government servant. On the very face of it, the submission of application in this case is hugely belated. The impugned order is therefore sustained.
3.The writ petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are also dismissed. Sd/- Assistant Registrar(RTI) /True Copy/ Sub-Assistant Registrar To 1.The District Collector, Trichy District, Trichy.
