Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to pass an interim direction, to the learned Judicial Magistrate to return the original RC Book in connection with Cr.No. 110/2014 in C.C.No. 113/2015.

Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.R.SEVUGARAJA, Advocate for the petitioner and of M/S.KANDASAMY,Government Advocate(Crl.Side),on behalf of the Respondent, the court made the following order:- The learned counsel appearing for the petitioner and the learned Government Advocate(Crl.Side) appearing for the respondent are present.

2. Heard both sides.

3. The learned counsel for the petitioner represented that the application filed by the petitioner before the learned Judicial Magistrate, Peraiyur, for returning the original Registration Certificate is kept in connection with the Cr.No.110 of 2014 in C.C.No.113 of 2015 and the Trial Court has returned the petition for certain defects. The reasons assigned by the Trial Court for returning the same are not acceptable. Hence, the petitioner filed the present petition.

4. This Court passed the order in Crl.R.C.(MD)No.353 of 2014, dated 23.07.2014, allowed the petition and also released the vehicle bearing Registration No.TN 58-AZ-2062 with conditions. Accordingly, this Court already decided the above issue in the main case, the https://hcservices.ecourts.gov.in/hcservices/

Trial Court is ordered to return the original Registration Certificate of the petitioner, if proper application filed by the petitioner.
