Second Appeal filed under Section 100 of the Civil Procedure Code, praying against the judgment and decree in A.S.No.43 of 2003 on the file of the District Judge, Sivagangai and dated 22.06.2004 in confirming the judgment and decree in O.S.No.55 of 1994 on the file of the Sub Court, Devakkottai and dated 27.12.2002. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.S.SRINIVASA RAGHAVAN, Advocate for the petitioner and of MR.S.MANIKANDAN, Advocate on behalf of the Respondents, the court made the following order:- This petition has been filed by the petitioner seeking to condone the delay of 510 days in filing a petition to set aside the order dated 04.09.2018, made in S.A(MD)No.172 of 2004, which was dismissed for non-prosecution.
2.Heard the learned counsel appearing for the respondents. 3.Considering the reasons stated in the affidavit filed in support of the petition and also considering the length of delay, this Court is inclined to allow this petition subject to the payment of cost of Rs.1,000/- (Rupees one thousand only) to the Legal Services Committee, attached to this Bench on or before 28.09.2020, failing which, this petition shall stand dismissed automatically without any further reference to this Court.
