JUDGMENT
(Judgment of the Court was delivered by R.SURESH KUMAR, J.) This Writ Appeal is directed against the order of the learned Single Judge dated 18.11.2019 made in W.P.(MD)No.3162 of 2015. 2.In the said order, a direction was given to the appellant herein to revise the pay scale of the respondent / writ petitioner in accordance with G.O.Ms.No.338, Finance (Pay Cell) Department, dated 26.08.2010 within a period of three months.
3.Aggrieved by the said order, the appellant, who is the respondent in the Writ Petition, filed this Writ Appeal. 4.When the Writ Appeal is taken up for final hearing today, the learned Standing Counsel for the appellant as well as the learned counsel for the respondent would submit that during the pendency of the Writ Appeal, there has been compromise entered into between the parties that has been reduced in writing by joint compromise memo dated 13.12.2022, where 2/5
inter alia the following had been agreed upon between the parties:- "2.Now, the appellant has taken a decision to appoint the respondent as Mine mate under the transfer of service in the pay level-8. The respondent agreed for the same and expressed his willingness that if he is appointed as Mine mate he will not press the claim made in W.P.(MD)No.3162 of 2015. The contents of this compromise memo were read over and explained to both parties. Both parties after having understood and accepted as true and correct, put their signature in the presence of their respective counsel. To that effect this Memo is filed.
Dated at Madurai on the 13th day of December, 2022."
5.Relying upon this joint compromise memo filed on behalf of the parties, the learned counsel for both the parties want this matter to be disposed of after recording this joint compromise memo. Having considered the submissions made by both sides, taking note of the aforestated joint compromise memo and recording the contents therein as extracted herein above, this Court feels that this Writ Appeal can be closed, accordingly, it is closed by recording the aforestated joint compromise memo. No costs. Consequently, connected miscellaneous petition is 3/5
closed.
