Side) For Intervener : MR.V.THIRUMAL, Advocate PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners who arrayed as A1,A2 and A5 apprehend arrest at the hands of the respondent police for an alleged offence punishable under Sections 294(B), 324 and 307 of IPC in Crime No.186 of 2015 on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that the de facto complainant is running a Readymade showroom at Melur. On 08.03.2015, three persons came to the shop and asked for a green colour T-Shirt, since it was not available they used filthy language and also attacked the de facto complainant with knife.

3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case, due to business motive.

4.The learned Government Advocate (Crl.side) would submit that the injured has discharged from the hospital and the petitioners have no previous case.

5. Considering the facts and circumstances of the case and also considering the fact that the injured has already been discharged from the hospital, I am inclined to grant grant anticipatory bail to the petitioners. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Melur, Madurai and on each of them are executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.30 am until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
